Ste. Genevieve County Commission et al. v. Mike Kehoe et al. is a case with potentially significant implications for local government revenue in Missouri. The lawsuit challenges Senate Bills 153 and 97 (2021), commonly known as the Wayfair legislation, alleging violations of the Hancock Amendment. The counties argue that expanding sales tax exemptions for manufacturing and mining equipment—including utilities, materials, and equipment—to voter-approved local sales taxes reduced revenue needed to meet existing obligations and perform state-mandated functions.
Because the lawsuit challenges the legislation as a whole, a ruling in the petitioners’ favor could undermine the legal foundation for the implementation of use taxes under SB 153 and 97 state-wide. This would dissolve all currently approved local use taxes, require the state to reauthorize use taxes in subsequent legislation, and require political subdivisions to reacquire voter approval.
A hearing for this case is scheduled on November 30th, 2026 in the Cole County Circuit Court. View the case HERE. |
