Pre-filing of Missouri Legislation

Pre-filing of bills for Missouri's 2025 legislative session started on December 1st. The First Regular Session of the 103rd General Assembly will commence on Wednesday Jan. 8th and close on Friday May 16th.

Marijuana Tax Issue May Go to State's Highest Court

St. Louis County Circuit Court previously ruled that Art. XIV, Sec. 2 of Missouri's Constitution authorized both municipalities and counties to levy a local option sales tax up to 3% on the sale of recreation marijuana. The Court of Appeals for the Eastern District of Missouri recently reversed the lower court's decision in their Nov. 12th written OPINION.

St. Louis and St. Charles Counties have appealed the decision, and the case will likely head to the Missouri Supreme Court. Municipalities that have passed this local option sales tax are not expected to be affected by the Supreme Court's decision.

 

 Candidate Filing for Municipal Election

Candidate filing for the April 8, 2025 Municipal Election runs from December 10th-31st.

Section 115.127, RSMo. requires that municipalities:

  • Stay open until 5pm on Dec. 31 to accept candidate filings, and

  • Publish a notice of candidate filing in a newspaper before Dec. 10

Upcoming Statutory Deadlines

Municipalities with a January-December fiscal year must:

  • Adopt an annual budget before their fiscal year begins Jan 1 (§ 67.010). If no budget is approved, the previous year's budget applies (§ 67.070). 

  • Publish in a newspaper the semi-annual financial statement for the previous six month period (3rd class cities § 77.110), (4th class cities §  79.160), (villages § 80.210).

  • Submit annual financial report to the state auditor (§ 105.145).

Proposed Missouri Constitutional Amendments (FULL TEXT):
  • Amendment 2 - licensed sports wagering (PASSED)
  • Amendment 3 - reproductive healthcare (PASSED)
  • Amendment 5 - additional gambling boat on the Osage River (FAILED)
  • Amendment 6 - funding for law enforcement salaries & benefits (FAILED)
  • Amendment 7 - voting regulations (PASSED)
  • Proposition A - increasing minimum wage (PASSED)
Proposed St. Louis County Charter Amendments:
  • Proposition C - authorizes the county council to hire separate legal counsel (PASSED)
  • Proposition O - provides that county elected officials' terms begin on the same day (PASSED)
  • Proposition A - provides how vacancies on the Port Authority Board of Commissioners shall be filled (PASSED)
Municipal Initiatives
  • Green Park passes additional 3% sales tax on retail sales of marijuana (Prop M)
  • Kirkwood removes residency requirement for their city attorney (Prop R) and establishes a half-cent TDD (Prop T)

MSD Receives Loan

The Missouri Department of Natural Resources announced that they awarded a $640 million low-interest loan to MSD for upgrades to wastewater systems expected to be completed in 2028. This Clean Water State Revolving Fund loan is the largest in the fund's history and is estimated to save MSD ratepayers over $400 million in interest payments over the loan's 30 year term.
